The AI Compliance Evidence Problem Nobody’s Talking About

Every week, I see another AI governance vendor launch a “compliance checklist” or a “policy template generator.” The implication is always the same: download this document, fill in the blanks, and you’re compliant.
That’s not how Colorado SB 24-205 works. And building a compliance program around that assumption is how organizations end up exposed when the Attorney General comes calling.

The Affirmative Defense Is Time-Dependent
SB 24-205 provides a rebuttable presumption of compliance for organizations that demonstrate alignment with the NIST AI Risk Management Framework. That presumption is your legal shield - the difference between a defensible position and an open liability.
But the operative phrase is “demonstrate alignment.” Not “claim alignment.” Not “intend to align.” Demonstrate.
Demonstration requires evidence. And evidence - the kind that survives an investigation - has to accumulate over time. You need:
• Bias audit records with timestamps showing regular, recurring audits across protected classes - not a single audit run the week before enforcement
• Consumer disclosure logs documenting that every person affected by a high-risk AI decision was notified, with delivery records stretching back months
• Incident response documentation proving that your organization had a process for detecting and responding to algorithmic discrimination before a complaint was filed
• Risk management policy versioning showing the policy existed, was reviewed, and was updated - not created in a single session
Three months of clean, documented governance tells an AG investigator: “This organization takes compliance seriously.” One week of hastily assembled documentation tells them: “This organization panicked.”
112 Days: The Math That Matters
As of March 10, 2026, there are 112 days until SB 24-205 enforcement begins on June 30.
A proper AI compliance program takes approximately 90 days to build and season. That includes system inventory, risk classification, policy development, bias audit configuration, consumer notice deployment, evidence generation, and NIST AI RMF mapping across all four core functions: Govern, Map, Measure, Manage.
The buildout timeline:
Start today (March 10) → Complete June 8 → 22 days of accumulated evidence before enforcement. Defensible.
Start April 1 → Complete June 30 → Zero margin. Program finishes the day enforcement begins. No accumulated evidence. Risky.
Start May 1 → Complete July 29 → Operating without an affirmative defense for 30 days of live enforcement. Exposed.

What Accumulated Evidence Actually Looks Like
There’s a material difference between a compliance program at Week 1 and a compliance program at Week 12:
Week 1: You have a risk management policy, system inventory, and initial risk classifications. No audit data. No consumer notice history. No incident response record. If the AG asks for evidence of ongoing governance, you have documentation of intent - not execution.
Week 6: You have 4-6 bias audit cycles across your AI systems. Statistical results (four-fifths rule, Fisher exact test) showing recurring analysis. Consumer notices deployed and delivery-tracked. Your evidence chain has depth.
Week 12: You have a full quarter of documented compliance activity. Bias audit trends showing consistency (or improvement). Consumer disclosure records with months of delivery history. Evidence snapshots chain-linked with SHA-256 verification. This is the profile that supports an affirmative defense. This is what “demonstrate alignment” means.
The Penalty Math Puts This in Perspective
SB 24-205 penalties are calculated per violation, per consumer affected. A single AI hiring tool screening 2,000 applicants without proper disclosure: $20,000 × 2,000 = $40 million in theoretical exposure. Realistic settlement range: $500K-$5M. Either way, it’s multiples of what a full compliance program costs for a year.
